GREENS FITNESS ACADEMY
TERMS AND CONDITIONS
Website • Courses • Learning Platforms • Student Services
Effective Date: 2026
1. Introduction and definitions
These Terms and Conditions (“Terms”) govern access to and use of the Greens Fitness Academy website, course information, learning platforms, classes, learning materials, assessments, student-support services and related offerings.
“Greens Fitness Academy”, “Academy”, “we”, “us” and “our” refer to Greens Fitness Academy, operating under the brand Greens Fitness Academy. “Candidate”, “student”, “you” and “your” refer to any person who visits the website, makes an enquiry, registers, applies, pays for, or enrols in a course or service.
These Terms should be read together with the applicable course page, written offer, invoice, Student Enrollment Agreement, course schedule, fee/payment plan, refund policy and Privacy Policy. If a course-specific document expressly governs a particular matter and is consistent with applicable law, that document will apply to that matter. Nothing in these Terms is intended to remove a right that cannot legally be excluded.
2. Acceptance of Terms and eligibility
By browsing the website, submitting an enquiry, creating an account, registering, making payment or enrolling, you acknowledge that you have had an opportunity to read these Terms and agree to the provisions applicable to your use or enrolment.
If you do not agree with these Terms, do not use the relevant website or service and do not proceed with enrolment. If you are under 18, a parent or lawful guardian must review and consent to enrolment where required by law and the course’s eligibility rules. The Academy may require age or guardian details where reasonably necessary.
You must satisfy the eligibility, prerequisite, language, identification, attendance and other requirements published for the course. Submission of an enquiry or application does not by itself guarantee admission.
3. Academy services and course information
Depending on the course and intake, the Academy may provide theory classes, practical training, live online sessions, recorded lessons, assignments, assessments, student support, learning resources, career-development activities, community initiatives and other services described in the applicable course information.
Course format, delivery mode, venue, timetable, faculty, syllabus, duration, access period, class recordings, practical attendance, equipment requirements, assessment method, pass criteria, eligibility, fees and included services may differ by course or intake. The applicable course page and written enrolment documents should be checked before payment.
The Academy aims to keep published information accurate and current. If a material error or change is identified, the Academy will take reasonable steps to correct it and communicate material changes to affected candidates where reasonably practicable. Images, examples and promotional materials are illustrative unless a specific feature or benefit is expressly stated as included.
4. Third-party certifications, registration and awarding bodies
Some courses may prepare students for, or be associated with, an external awarding, accrediting, registering, examination or assessment organisation. The relevant organisation and the nature of its role should be stated in the applicable course information.
Where a credential, examination, registration or certificate is controlled or issued by an external organisation, that organisation’s eligibility criteria, policies, assessment rules, pass requirements, examination arrangements, fees, timelines, re-evaluation procedures and certificate-issuance requirements may apply and may change from time to time.
The Academy does not guarantee that a student will pass an assessment, obtain a third-party credential, receive registration, secure employment or achieve a particular career outcome. Final decisions within an external organisation’s authority remain subject to that organisation’s procedures.
The Academy will not describe a qualification as accredited, recognised, approved, equivalent or guaranteed for employment unless the statement is accurate and supported. Students should independently review the credential’s scope, recognition, prerequisites and limitations before enrolling.
Where a third-party organisation changes its rules, criteria, assessment method, examination arrangements, fees or decision, the Academy will explain the information reasonably available to it and the steps, if any, within its control. The Academy cannot promise to reverse an external decision, provide internal records it does not possess, or compel a third party to disclose confidential assessment information.
5. Enquiry, application and enrolment
You must provide accurate, complete and current information during enquiry, registration and enrolment, and promptly update any material change. The Academy may request reasonable supporting documents to verify identity, eligibility, qualifications or student records, subject to applicable law and the Privacy Policy.
Enrolment is confirmed only when the Academy communicates acceptance or confirmation in writing, or otherwise confirms acceptance through its stated enrolment process. Payment alone does not override eligibility requirements or amount to confirmation where the Academy has not accepted the application.
The Academy may decline or defer an application where eligibility requirements are not met, information is materially inaccurate or incomplete, a course is full or unavailable, or there is another lawful and reasonable basis. Where payment has been received for an application that is not accepted, the Academy will handle the amount in accordance with the disclosed policy and applicable law.
You are responsible for reviewing the course description, delivery method, schedule, requirements, fee structure and relevant policies before confirming enrolment.
6. Fees, payment, instalments and taxes
The course fee, payment due dates, instalment plan, applicable taxes and any separately payable examination, registration, resit, re-evaluation, travel, equipment or certificate fees will be disclosed in the relevant course information or written payment terms before enrolment, to the extent applicable.
You agree to pay the amounts that were clearly disclosed and accepted for your enrolment. Payments must be made through payment methods authorised by the Academy. Retain receipts and transaction references for your records.
Never share your banking password, card PIN, one-time password (OTP) or other confidential payment credentials with Academy staff or any person claiming to represent the Academy. The Academy will not ask you to disclose your banking password or OTP.
Where an instalment plan has been agreed, a missed or delayed payment may lead to reminders and, after notice and a reasonable opportunity to resolve the issue, temporary restriction of access or other proportionate action where permitted by law and the agreed plan. Such action will not remove any mandatory rights available to you under applicable law.
Any applicable taxes will be charged as required by law and as disclosed in the invoice or payment terms. The Academy will communicate any change in tax treatment where reasonably practicable.
7. Cancellation, withdrawal, refunds, deferrals and transfers
The refund, cancellation, withdrawal, deferral, batch-transfer and course-substitution rules for an enrolment will be set out in the applicable course-specific refund policy or enrolment schedule. That policy should be provided or made available before payment. Please read it carefully and retain a copy.
To request a refund or a change to enrolment, contact greensfitnessacademy@gmail.com and include your full name, course, enrolment reference, payment/transaction details, date of payment and reason for the request. Do not send passwords, OTPs or unnecessary sensitive financial information.
The Academy will acknowledge and assess a request promptly and communicate its decision and, where approved, the expected processing timeline. Any refund will be calculated in accordance with the disclosed policy and applicable law, taking account of services already delivered, access already provided, amounts properly payable to third parties that cannot reasonably be recovered where lawful, and any mandatory consumer rights.
A refund, deferral, transfer or substitution is not automatically approved merely because a request has been submitted. A request will be assessed under the applicable policy and applicable law. Any approved change, its conditions, applicable charges and revised schedule must be confirmed by the Academy in writing.
External examination or certification-body changes
Where an independent awarding, examination, assessment or registration body—including, where applicable, ACE, EREPS or a Skill India-related body—changes its rules, eligibility criteria, assessment method, pass criteria, examination arrangements, fees or certification decision, the Academy may not control that decision. A pass/fail result or change made by an external body does not, by itself, establish that the Academy caused the result or automatically determine refund eligibility. Any request for a refund, alternative course delivery, transfer or other remedy will be assessed individually in accordance with the applicable course-specific policy and law, considering the Academy’s commitments, services delivered, the circumstances and impact of the external change, applicable third-party charges and available remedies.
Nothing in this section excludes responsibility for the Academy’s own acts or omissions, inaccurate representations, failure to deliver agreed services, or any statutory consumer rights. No term is intended to exclude rights or remedies that cannot lawfully be excluded.
8. Learning platforms, access, attendance and completion
You are responsible for maintaining suitable internet access, devices, software and facilities for online learning, and for attending required in-person sessions at the venue and time communicated for your course.
Live sessions, recordings, learning portals and downloadable materials are provided only to the extent included in your course and subject to the stated access period, platform availability, security requirements and reasonable operational changes. Access may expire at the end of the published period.
You must complete required attendance, practical sessions, assignments, assessments and other course requirements within the published deadlines unless an extension or accommodation is approved in writing. Failure to complete requirements may affect eligibility for completion or certification.
You must keep login credentials confidential and must not share accounts, permit unauthorised access, record restricted sessions, bypass access controls, or distribute links or learning resources to people who are not authorised to use them.
The Academy may temporarily suspend or restrict access where reasonably necessary to protect platform security, investigate suspected misuse, address a serious policy breach or comply with law. Where practicable, the Academy will provide notice and an opportunity to respond, subject to the urgency and seriousness of the issue and applicable law.
9. Assessments, examinations, re-evaluation and certificates
Assessment formats, attendance thresholds, pass criteria, retake opportunities, re-evaluation or appeal processes, deadlines and related charges will be communicated for the relevant course where applicable. Where an external body administers an assessment, its rules and procedures may take precedence for matters within its authority.
Students must follow examination instructions and submit their own genuine work. Academic misconduct includes cheating, plagiarism, impersonation, collusion where prohibited, falsification of documents or records, unauthorised assistance, interference with assessment systems, and misrepresentation of results.
Suspected misconduct may be investigated fairly and proportionately. Depending on the circumstances and applicable rules, outcomes may include a warning, a requirement to resubmit work, an assessment being invalidated, restriction of access or termination of enrolment. The student will be given an opportunity to explain the matter where appropriate, subject to examination rules and urgent safety or integrity needs.
Certificate issuance may depend on course completion, attendance, assessment results, identity verification, fee clearance and/or processing by an external organisation. Processing periods are estimates unless expressly guaranteed in writing. The Academy cannot guarantee a third party’s processing time or decision.
Where a student disputes a result, the Academy will explain the process available to it and, where applicable, guide the student to the relevant awarding or assessment body’s published procedure. The Academy cannot promise access to confidential marking materials or a change in result where the decision rests with an independent body.
10. Student conduct and community participation
Students must treat faculty, staff, fellow students, clients, visitors and partners respectfully. Harassment, discrimination, threats, bullying, violence, unlawful conduct, disruption of classes, deliberate damage to property, and unauthorised sharing of another person’s personal information are prohibited.
Students taking part in groups, challenges, Leaders Club activities, career support, placement assistance, events or other community initiatives must follow the guidelines communicated for those activities. Participation may be optional and may require additional consent or eligibility.
The Academy may investigate reported misconduct, consider the student’s explanation where appropriate and take proportionate action. Serious safety concerns may require immediate temporary restrictions while a review is completed. Any action will be subject to applicable law and any relevant external-body requirements.
Participation in optional programmes, challenges, networking or community activities does not guarantee employment, income, clients, placement, business success, awards or any particular result.
11. Fitness practice, health, safety and professional scope
Fitness education and practical training involve physical activity and may carry inherent risks, including strain, injury or aggravation of an existing condition. Students should disclose relevant limitations to the appropriate instructor, seek medical advice where appropriate, and follow safety instructions, equipment guidance and venue rules.
Course content is educational and is not a substitute for medical diagnosis, treatment, rehabilitation or individual clinical advice. The Academy does not represent that completion of a course authorises a student to diagnose or treat medical conditions or to practise a regulated healthcare profession.
Students must practise within their competence, use appropriate screening and safe coaching methods, obtain informed consent where relevant, respect client confidentiality, and refer clients to a suitably qualified healthcare professional when a concern falls outside their scope of practice.
Students are responsible for complying with laws, professional standards, facility rules and insurance requirements applicable to their own practice. The Academy does not control how a student applies course information outside the Academy’s supervised learning environment.
12. Intellectual property and permitted use
Unless expressly stated otherwise, website text, videos, presentations, manuals, recordings, graphics, logos, course resources, assessments, layouts and other Academy materials are owned by or licensed to the Academy or the relevant rights holder and may be protected by intellectual-property laws.
Enrolment grants a limited, personal, non-exclusive, non-transferable and revocable right to use the materials for your own learning during the authorised access period. It does not transfer ownership or grant a right to commercialise the materials.
Except where applicable law permits or the Academy gives prior written permission, you must not copy, reproduce, sell, publish, upload, distribute, broadcast, modify, create derivative works from, teach commercially from, remove ownership notices from or otherwise exploit Academy materials. You must not share restricted recordings, assessment questions or answer keys.
Students retain rights in their original work, subject to any clearly stated and separately agreed permissions needed for assessment, accreditation, recordkeeping or course administration. The Academy will not assume broad promotional rights over student work merely because it was submitted for assessment.
13. Website use, security and third-party links
You must not misuse the website or learning platform, attempt unauthorised access, introduce malicious code, interfere with systems, circumvent technical restrictions, scrape restricted content, impersonate another person, or use the website for unlawful, deceptive, fraudulent or infringing purposes.
The Academy may maintain, update, suspend or discontinue parts of the website or platform for maintenance, security, operational or legal reasons. Reasonable steps will be taken to minimise disruption, but uninterrupted or error-free availability cannot be guaranteed.
The website may contain links to third-party websites, payment providers, platforms or resources. These are provided for convenience or course delivery where applicable. The Academy does not control every third-party service and is not responsible for its independent content, policies, availability or practices. Your use of a third-party service may be governed by that provider’s terms and privacy notice.
14. Career support and outcomes
Career guidance, interview preparation, networking, Leaders Club activities, placement assistance, referrals or other career-development services, if offered, are support services and do not guarantee a job, placement, clients, earnings, promotion, business success or any particular career outcome.
Outcomes depend on factors beyond the Academy’s control, including student performance, experience, qualifications, conduct, local law, employer requirements, market conditions and third-party decisions. Students are responsible for ensuring that their qualifications and professional activities meet the requirements applicable to the role or jurisdiction in which they seek to work.
15. Privacy, communications and student records
Personal information is handled in accordance with the Academy’s Privacy Policy, which should explain what information is collected, the purposes and legal basis for use where applicable, sharing, retention, security measures, individual rights and privacy contact details.
The Academy may use the contact details supplied by you to communicate about enrolment, payments, classes, assessments, certificates, student support, service changes and complaints. Promotional communications should be handled in accordance with applicable law and any required consent or opt-out mechanism.
You should not submit another person’s personal information unless you are authorised to do so. The Academy will handle student records and requests relating to them in accordance with its Privacy Policy and applicable law.
16. Disclaimers and limitation of liability
To the extent permitted by law, the website and general information are provided on an as-available basis. The Academy does not warrant that the website will always be uninterrupted or error-free, that every technical issue can be resolved immediately, or that participation in a course will produce a particular professional, financial, health, fitness, employment or business outcome.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable consumer rights, or limits responsibility for the Academy’s own acts or omissions where the law does not permit such limitation.
Subject to the preceding paragraph and applicable law, the Academy will not be liable for indirect or consequential losses that were not reasonably foreseeable. Nothing in this section is intended to remove any remedy that a student or consumer is entitled to under mandatory law.
17. Suspension, termination and consequences
The Academy may suspend or terminate access or enrolment for a material breach of these Terms, non-payment after applicable notice, fraud, serious misconduct, security risks, unlawful activity or where required by law or an external awarding body’s rules.
Where reasonably practicable, the Academy will communicate the reason and provide an opportunity to respond or remedy the breach before taking final action. Immediate temporary action may be taken where necessary to protect safety, assessment integrity, other students, staff, systems or legal compliance.
Any financial consequences, access expiry, certificate eligibility or refund following suspension or termination will be determined under the applicable course-specific policy and law. Termination does not remove payment obligations already lawfully accrued or rights that cannot be excluded.
18. Changes to services and these Terms
The Academy may revise these Terms to reflect changes in law, services, systems, security requirements or operations. The current version and effective date will be published on the website.
Material changes affecting existing enrolments will be communicated where reasonably practicable. Changes will not retrospectively remove accrued rights or override a mandatory legal protection. If a change materially affects a paid service, the Academy will handle the matter in accordance with the applicable enrolment documents and law.
19. Complaints and grievance procedure
Questions, concerns or complaints may be sent to Greens Fitness Academy, Perinthalmanna, Kerala - 679322, email greensfitnessacademy@gmail.com, phone +91 9074 310 038 / +91 98959 75546. Include your name, course, enrolment reference, relevant dates and a clear description of the issue. Please avoid sending passwords, OTPs or unnecessary sensitive information.
The Academy aims to acknowledge a complaint promptly and provide a substantive response within standard working days, or update you if more time is required.
Where a complaint concerns an external awarding, examination, assessment or registration body, the Academy will explain the steps within its control and provide available information about the relevant external process. The Academy cannot guarantee the outcome of a complaint made to an independent body.
Nothing in this section prevents a student or consumer from approaching a competent authority, consumer commission or other forum where permitted by applicable law.
20. Governing law and disputes
These Terms are governed by the laws of India. Disputes will be handled by the competent courts, consumer commissions or other forums having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to give up a statutory right to approach a forum or authority that has jurisdiction under applicable law. The parties may attempt to resolve concerns through the Academy’s grievance process, without preventing access to legally available remedies.
21. General provisions
Severability: If any provision is found invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply to the extent lawful.
No waiver: A failure or delay by the Academy to enforce a provision does not automatically waive its right to enforce that provision later.
No transfer by student: You may not transfer your account, enrolment or rights under these Terms to another person without the Academy’s written approval and compliance with the applicable course policy.
Entire understanding: These Terms, together with the applicable course-specific documents and policies referred to in them, describe the terms governing the relevant website use and enrolment. If documents conflict, the specific written enrolment terms will be interpreted consistently with these Terms and applicable law; mandatory law prevails.
